Such silly answers. Actually it is on a state by state basis. In most states--it is illegal to be caught DRINKING alcohol. Not to have drunk alcohol That seems to be a subtle difference but really it is quite substantial.
You cannot be holding an alcoholic beverage, you cannot purchase an alcoholic beverage. However there is no rule about having been drunk.
Now some states are finally beginning to pass an extention on the open container law. Your body can be considered an open container in certain states but that is a very recent law and slowly going through state's legislatures.
Also pictures cannot be considered proof by police. Just like personal video cannot, as there is no proof it was not set up. Even if you have video of a person trying to poison your drink--it could be argued by a halfway decent attorney that it was acting. You had not been consuming any alcohol but were merely appearing to have done so. Photoshop and the works. Therefore even a picture of you holding a beer bottle does not prove that the photo has not been *altered* from its original form.
No matter what state you live in your pictures do not give them probable cause to follow you around until you get drunk again and they can catch you. Geez--it's a police force. They actually have a job to do and don't have time to stalk you until you drink again. And most states do not allow seizure of property to prosecute misdemenors, only felonies.

Well underage drinking is against the law. Everyone knows that. When I snoop through singles sites there are pictures of 18-20 year olds with beers in their hands. So I kind of doubt it's enforced.

No, but if you commit another crime involving alcohol, the pictures stand as evidence. Also, schools look at social networking sites for things like that. It's a bad idea to post pictures of yourself doing illegal things on the internet.

im 14.and some of the people in my school do things like this,some as young as 11 or 12 go out clubbing and drinking etc. and i think its just ridiculous that there trying to grow up too fast.

no because there is no way to prove it is alcohol. it could be water. it could of course be enough to provide evidence for a search warrant of the under age persons home
