Only if the seller sold it as in working order, its a contract, so if he sold it 'as is' then you cant do anything.
Otherwise, you can contact the seller as the goods did not arrived as in working order.
The seller need to respond, if not, you can contact ebay to file a compliant to recover your money.

Contact the seller; be sure the ad doesn't say something like "as is," though, or you're out of luck. Presuming it doesn't say so, contact the seller, and let them know of the problem; be sure to contact them through eBay's mail, and NOT your private e-mail account; that way, eBay has proof of what is said. If the seller doesn't respond, or responds unfavorably, then lodge a complaint with eBay; also, be sure to put negative feedback if it is so warranted.

Don't get caught up in the "this person is mean" attitude - that's a childish point of view. It could be an honest mistake, or it could even be a mistake on your part. Either way, eBay will deal with you if you're reasonable about it; if a product is not as advertised, then it's their problem as well as yours.

I strongly suggest ALWAYS using PayPal; they're very good about dealing with bad sellers.

First, contact the seller. If the seller does not respond, you can leave negative feedback, or contact eBay to see if they can offer any remedies. If it was sold "as-is", you are out the $70, but if it was advertised in working order, you may have a chance at getting your money back.
