Should a congressman be proposing to put the 10 commandments up in courthouses, when he cant even name them?

He should just be content with writing those 10 commandments on the inside of his hand or on a cheat sheet rather than imposing them on the rest of us with our tax money.

um, yeah they can. If you can't extemporaneously retell the Communist Manifesto should you be allowed to proliferate its ideas, of course. And it is permissible under the First Amendment, because that amendment only forbids Congress from passing a law declaring a religion to be that of the state. And putting a display up in a courthouse hardly equates to a law.
