we live in New Jersey and have not lived together in 8 yrs. He has an addiction problem and is institutionalize most of the time. i also have proof of physical abuse.

Yes you can. When a person is unable to be located, a notice of legal action may be published in newspapers. A time limit to respond is usually given. If he fails to respond, then the action may proceed without his involvement. It stops people from trying to put things off by refusing to accept the problem.

It really doesn't work like T.V. shows in the real world. Take a deep breath relax he can't just up and leave with your child, unless he wants to get into a lot of trouble. He has to be served and then he has 30 days to answer. An answer is usually a reply for what you have stated you want on your petition papers after the divorce if he doesn't answer in 30 days then it can be defaulted and you get whatever you stated in your petition. If he answers then you begin the long process of orientation, then mediation if the parents can't come to terms or an agreement then the mediator and judge come to terms for you guys. Through out the hearings and court dates you will be able to see your child or should be able to see her if not you are better off getting an attorney.

This is a good question!! I think after so many years your marriage is null and void!! At least that what every one tells me!! I've been separated for almost 14 years and I have no idea where my ex is. We were on the other side of the country when we split. He stayed and I left, we have had no contact whatsoever since. To me it should be null and void, but I'm not so sure what the law is about that. My bf of 5 years always tells me I have to get a divorce before we can ever marry. After all this time, I consider myself unmarried!! I will check back to see what responses you get!!

As long as there is some way to serve him, either thru an abuse clinic or one of the institutions where he goes for treatment or a family member. And sometimes even when someone doesn't have an address for service after due diligence in attempting to serve the papers they will still grant it. Good luck and God Bless.

Yes you can. You have to let the court know he is homeless. So you might have to have it run in the news paper for a certain amount of time. If there is no response your divorce will be granted.

What happened to in sickness and in health way to kick a dog when it 's down why wont you help him get his life together before you throw him to the wolves. I understand he has wronged you in the past but think about why you married him in the first place understand I am not telling you not to divorce him all i'm saying is try to help him get off the streets God I hope there aren't any kids involved

well- yes you can but the thing is that he won't receive the papers to a given adress so it will be a bit hard. As of now- the marriage is NUL but file the papers even if they can't reach him. The process won't take so long since you are alreaday separated for so long.

Yes, I seems doubtful he would contest it after 8 years of separation, and as he has no assets to fight with/for, it should be a fairly quick transaction.
