Any good waiter should ask, but I would politely say "Oh, I'm not quite finished" if I thought that they were about to take my plate.

I would be a bit upset and most likely get a whole new plate to go for free! It has happened to me before

I wouldn't care one way or the other. However, what I would care about is people reporting abuse of someones answer just because they didn't like the response. One might tend to think that maybe they could get even with the other one.
