Any good waiter should ask, but I would politely say "Oh, I'm not quite finished" if I thought that they were about to take my plate.

I wouldn't care one way or the other. However, what I would care about is people reporting abuse of someones answer just because they didn't like the response. One might tend to think that maybe they could get even with the other one.
