Uhm,,,,,I am assuming you had paternity legally established and your baby's father is named on the birth certificate. If that hasn't been done...you need to visit your child support agency immediately and start there.

Depending on the state, support for one child is generally 17-23% of gross income. You're looking at a substantial amount of support. And no, he can not say he won't pay if he is indeed the father. That is why you need to apply to child support immediately--even before you separate. Courts generally do not set support retroactively, but will (depending on state) set support back to the date of your application. Meaning if you don't apply until 3 months after you separate...that is the date child support will begin.....not the date of separation.

If you are living with him he does not have to pay anything. To see what the amount should be you can go to your state's child support enforcement site and look up the guidelines and forms to calculate the support amount. You should apply with your local child support enforcement agency for assistance in establishing paternity if necessary and setting up a support order that will be enforceable by the court. They will do this at little or no cost. You cannot apply till you separate however. As long as you are living together it is considered that he is supporting the child. You do not have to be married to have a child nor to get a child support order. Not all children are not born to people who are married you know..

Why in the hell are you listening to HIM! for god's sake!
Get an attorney, they usually work for nearly nothing when it comes to child support. Also, it depends on the state that you live in, but there is no law in the entire USA that says that he wont have to pay just because you 2 are not married. Tell him to have a great life, and by the way, see ya in court! You can actually fill out the paperwork yourself in most states and go to court without a lawyer and just tell the judge that you want child support. IT's not hard. All you have to do is go to J&D court in the town that you live in and ask for paperwork to fill out asking for Child support. The clerks there have the things you will need. There is no charge for filing the papers and you get a court date. Then, you go in, and tell the judge that you have a child with him and you want child support ordered. IT's that simple!
Best to you

That's sad Renee. but it's two sides to every story. Why are u worried about money...Remember you can never depend on a man...dad or not. Always be able to support your child regardless of what he does. Consider child support extra money. You should be able to pay electric, rent, water...alone. However, don't beleive in that money ratio crap. My husband only pays a petty $340 for two big teenagers, when he can afford to pay more. Child support is easy to avoid. He can always send a portion of the amount to get the Revenue Services off his back!

First off married or not he will have to pay child support. As long as he is the listed father on the birth certificate then you can go ahead and contact a lawyer and get the paperwork started for child support payment. They base the amount on how much he makes and the number of kids you have together. Sorry but I have no idea how much you would get. Contact a lawyer or your local Department of Human Resources for information on what steps to take.

so sad to hear your story, I am a single parent; it didn't go well too with my baby's biological father; we are not married too- true it will be difficult to ask for child support since you are not married- tho' the last name of the child is his? Please check on the law about this; but if the child's last name is yours; it will be really difficult to deal with this; if he is a decent man- even what happens he will still give child support- that is his child no matter what; I pray that things will be OK with your problem.

and you know what you tell him. yes you will pay child support because this is your child and the state will make you pay whether you like it or not, and guess what else. in some states, if you are not married, the mom gets full custody and gets to have control of the kid.

Don't worry. You will end up getting way more "child" support than you actually spend on the child.
