i previously lived with my mother and kids. i got my own house in november. i believed that it would be in the kids best interest not to be moved in the middle of the school year. the kids are moving back with me in june when they get out of school. because my mother applied for welfare(without my knowledge) i know have to pay child support, is that correct?

i give my mother $100 a week for the kids. I also buy there clothing, etc. i support my kids financially. I just had no idea that she filed for welfare

she receives $135 a month cash, food stamps and medicaid. I have health insurance through my job for my kids.

I read your question a little differently than the other folks who answered. You asked if you should be ORDERED to pay child support. I don't think you should. I think you may have gotten a document from your state's version of social services asking for reimbursement for money paid by the state while the children are with their grandmother. Is that correct? If you, this should only be temporary until they return to you. BTW-I think it was wise not to move them during the school year. My opinion is the state deserves reimbursement for the amount they spent on the children, but you have to be proactive and make sure the state knows when the children return to you. There are some nuances to your question that are confusing. If you're being ordered to pay the state, that's appropriate if the state paid for the children's care, but I'm curious as to what the state did. Did they put the children on medicare? If you have a court order, you have to honor it. I hope I understood what you're asking.

Yes, it is true. If you were getting child support you should have cashed it and made out another check for child care to your mother. That way the child support ordered was going to what it was suppose to, the children.

Then, you would have had a leg to stand on and could have proff that the court order x amount paid for support and it was paid to you and you in turn turned it over to your mother for it's original purpose.

The thing I would have done was that because in November you were mid year I would have over Christmas vacation transferred to children to their new home with me. But, that's just me.

Yes, if your mother is filing for welfare, you should pay child support. There's no reason for the state to pay for your kids--- you should be paying for them!
