I have a $500 debt for over a month to my ex-wifes attorney. Received a letter from my ex-wifes attorney stating that if I did not pay him the court appointed amount by mid May, he would attach my wages. Can he do that if I send him $50 a month?

Yes, he can. But he should take your offer of $50.00 a month. To attach your wages, he has to file a garnishment action and wait 30 days for you to answer. Then he has to get a Court Order. The Order gets served on your employer and your employer has 20 days to answer. Then he gets to start garnishing your wages. However, since it isn't for child support, he can only take 25% of your wages a month in my state (this varies from state to state). If you start sending him $50 a month now, you will have reduced the debt by a minimum of $150 before he can even do anything. I suggest writing him a letter with a $50.00 check enclosed. In the letter, acknowledge you owe the whole debt and tell him you will faithfully send him $50 per month until the debt is paid in full. Tell him you'll sign a promissory note if he wants.

He can do a lot more than attach your wages. You're beyond the "invoice" stage, the Court awarded him the money, he has a Judgment.

Your best bet would be to call him and set that up as a payment plan. $500 isn't all THAT much, and I'm sure he would agree to that if you are sincere, and follow through with your commitment.

sure he can. if you talked to them and tried to make payment arrangements but they feel you make enough to pay more per month they can do whatever they want !
