Unemployment denied my last claim then sent me a letter saying "You may have been seperated for misconduct in connection with your work." They are calling me later today to discuss it!!!! The reason i was fired was because i slacked off for a few months after working 5 years. Do you think this constitutes misconduct and do you think they are going to stop my unemployment benifits? Any suggestions?

What did your employer report to on their UI claim? Here is how it works:

-you file a claim with your statement saying why you left yoru job
-the employer receives a copy of your claim and has 10 days to send in their response
-UI decides whether or not your claim is valid and should be paid, and sends the decision to both parties
-each party has the right to appeal the decision if it was not in their favor

So, for example, if UI awarded the claim to you, your employer could have appealed that your were termianted for misconduct. Copies of any disciplinary action, attendance records, etc., can be sent to UI by the employer to support their version of events.

If the employer has info such as this and submitted it to UI, then, yes, it is very possible that they will reverse their decision and you will lose your benefits. If I were you, I would not state in the phone call that you "slacked off for a few months" since that will most certainly be viewed as misconduct.

There is a good chance of you being denied. You can't be terminated for misconduct or through any fault of your own.
However, let me say this. I had to fire a guy for poor performance and bad attendance, he still got to receive his unemployment-can't figure out how that happened, but it did. They will send your past employer a form to fill out to give their reasons for letting you go...

It depends on how you define "slacked off" and how badly you slacked off. If your attendance was poor, and/or you didn't do the basics of your job, uc could be denied, especially if you got written warnings but didn't improve.

If the reason for your unemployment is due to you having slackened in your peformance, chances are you'll be cut off.

Depends on what they say. If your former employer doesn't fight it probably not. If they fight it- then YES you will not get unemployment.

Start looking for a job.

Probably. If you weren't happy with your job you should've just left. No reason to just not do your job and expect them to pay you.
