Basically, 2 months ago, 4 of my friends and I got caught by police with burglary tools on the way out of the neighborhood. All we did was break a window, we didn't even step on the property. 4 of us got out on bail. The one that stayed was the one that threw the rock. He plead guilty to burglary, not attempted burglary. He had a public defender and got 5 years deferred adjudication.

My question is, what do you think are my chances with a private attorney? None of us have prior offenses. I don't even have a traffic ticket on my record. Most people I've talked to said I'm probably gonna get 2 or 3 years probation.

By the way, that is going to be my one and only crime I will ever commit. I have changed, even though I was never really bad in the first place besides this incident. Now, I'm a fragrance distributor that is making 35k a year and looking to make 50k by summer's end.

The answer to your question will depend on what state you live in. In some states burglary is specifically defined to include entry into the property. If you never entered into the property then you're guilty of a lesser crime. The public defender will never spend as much time on your case as a private lawyer, because he simply doesn't have the time. If you can afford a lawyer, hire one.

You will most likely get Community Service and mandatory counseling. You will get probation most likely too (2-3 years). It is good you have a private attorney. Your friend got a very long sentence even though he won't be doing any time.

Why don't you go into the military? It sounds like you may benefit from the discipline and job training. I'd recommend the Navy. You'd be on ships and not in the middle of the fighting. The life of crime is something I wouldn't wish on anybody.

I agree. Most first offenders, depending on the crime, or alleged crime, get probation. If you hire your own attorney, you have better chances of getting the charges dropped altogether. But if you take your chances on a public defender, he/she is getting paid whether they help you or not. I'm not saying that the PD is not good at his/her job, just usually more non-challant about it. If you can, hire your own attorney. You'll come out better.

well here in california residential burglary can get you time.. but if there was no proof of breaking in the house who knows
