The laws against fornication are on the books in a number of U. S. states. Fortunately, its not a federal crime. Even though the laws are on the books in some states (particularily southern states), they are rarely, if ever at all, enforced. In theory, however, you could be arrested in a state that still has fornication laws on the books. In the end, however, such a law could be a violation of one's (now tenuous with Bush's appointees on the court) Constitutional right to privacy.

The first answer is correct...adultury is a crime still on the books just not enforced in most states...like jaywalking

And also public lewdeness ...having sex in public is criminal

Also prostitution and solicitation of prostitution is illegal in the vast majority of areas.
