The company I was working for last year went under, and they threw out lots of perfectly good stuff. I rescued some items from the garbage because I hate to see anything go to waste. However, I don't really need these items. Is there any problem with me selling them on ebay or at a garage sale?

Hard to tell. You could call one of those lawyer talk shows I hear on AM talk radio sometimes. they could tell you.

I'd say it probably wouldn't matter - unless it had their logo all over it.

I mean -they are out of business and threw it away. I DOUBT you get in trouble - but anything could happen. At a garage sale, i REALLY doubt you'd have a problem. Ebay has more potential (if it really is wrong).

As the guy above siad, you could also donate it and take a write off.

They are trash that you are saving from clogging up a landfill. IT sounds legal to me. Even if the company was not defunct they threw the stuff away. Since they are out of business who would complain about it?

I suggest you ask a lawyer. I worked retail for many years (different companies) and I know that when an item was zeroed out and made it to the dumpster then it was illegal to take it out. That is, it was considered stealing.

Why not make a donation to some organization that can use the merchandise?
