A man was killed in an unfortunate traffic accident. His wife was pregnant. Before his death, he made out a will that said if his wife has a boy, his estate is to be divided 2/3 to the son and 1/3 to his wife. If his wife has a daughter, then the daughter gets 1/4 of the estate and the wife the remaining 3/4. Remarkably, the wife gives birth to twins, a boy and a girl. How should the estate be divided so that the proportions in the will are properly considered?

The son gets 2 times as much as the wife and the wife gets 3 times as much as the daughter.
Son = S
Wife = W
Daughter = D

S = 2W
W = 3 D or W/3 = D
S + W + D = 1 (100%)

substitute S and D
(2W) + W + (W/3) = 1

(10/3) W = 1

W = 3/10

solve for S and D,

S = 2 (3/10) = 3/5
D = (3/10)/3 = 1/10

So, the son gets 60%, wife gets 30%, and daughter gets 10%.

The previous idea of preserving the ratios son:wife = 2:1 and wife:daughter = 3:1 is interesting but maybe not conclusive.

Divide half the estate according to the son rule, and the other half according to the daughter rule. Then the son gets half of 2/3, which is one-third; the daughter gets half of a quarter, which is one-eighth; and the wife gets the rest, about 54%.

It depends on the states rules of construction. It's possible that the widow gets it all since the children were posthumous.

However, if that's not the case, the estate would be divided in two equal parts, with the son getting 1/3 of one part (1/6 of the total) and the daughter getting 1/4 of the other part (1/8 of the total) and the widow gets the rest.
