The judge in my divorce case (in Galveston County, Texas) has ordered that we come to an agreement or attend mediation before a certain date. I don't have an attorney, and I have no money (I have filed a response and a counter petition, though). Anyway, the court paperwork says failure to attend mediation and come to an agreement will result in the case being dropped. My wife is trying to bleed me for money, even though I am penniless.

So I guess my question is, If I don't attend the court ordered mediation (since I can't afford it), will anything bad happen (other than the case being thrown out)?

BTW: there are no kids, no property, no assets, and nothing to fight over except and old $1000 truck.

Most likely, a warrant will be issued for your arrest at some point, and you will go to jail.

What most likely will happen is if you dont attempt to show up for mediation is the Judge will throw out your counter-suit and automatically award your wife the divorce and everything she is petitioning for. You dont really need an attoney to speak for you in mediation as you know what you want or dont want and what youre willing to compromise to. If you dont, you sure will in a real hurry. Mediation is the Judges last attempt to let you two work it out andhopefully to walk out of the marriage with at least your shirt still on. The choice is yours so remember you still do have alot to lose. So you really cant afford not to show up at mediation. Also contact your locallegal aid association for free help. Good luck

Actually what that means is that YOUR side of the case will be dropped, you will basically forfeit your end of the mediation...the judge just might rule in her favor since SHE followed the instructions of the court and YOU didn't.

Dont' be a fool...go to the mediation by yourself..if you don't you have lost all hope of a sane resolution in the case. It is mediation, not a trial. She cannot get blood from a turnip. If you are lying about your financial condition, it will come out. And what is she suing for? Alimony? Courts do not look favorably on long alimony payments...usually one year is enough to allow her to get on her feet if she has not worked outside the home. Child support? You will pay child support according to formulae that are in place. IF you cannot afford child support, you can get a part time job. Good luck

If you can't afford it, you should be able to fill out a financial form to have the mediation fee waived. Don't miss the mediation. Judges frown on those who don't mediate, or show an attempt to compromise

why in the world would you not want to go to mediation? mediation is where you and the ex try to work something out legally, if you dont go you are totally hosed, they wont just throw the case out you will probably get in trouble and she will have the advantage in the legal fight that you could avoid with mediation

The mediator will send the judge an order of no compliance and no aggreement. It could look bad on your part since it was ordered by the judge.

It is bad enough that we have, within our Own courts, judges who will consult the Koran when making rulings. Here in Florida, a Mosque recently sued the Imam for running off with the loot. When the judge wanted to reference the Koran, the attorneys for the mosque argued that they did not come to our civilian courts to seek sharia law rulings. That they have their own system for that, if that is what they wanted. Do you think they would allow OUR justice system in Saudi-Arabia? Why are we always the ones doing the embracing of other cultures, even the ones that reject our own?

Well, you could end up having a warrant against you. End up in jail. AND, your wife could win a judgement of big bucks.

Show up for the mediation.

She very well could be awarded everything she's asking for because you did not show. If it's out of state and you cannot afford to get there, you might be made to afford paying her out the "dere ere". My advice...be there....attorney or no attorney. It looks good to the court that you made an effort.
