So here's the situation, I am moving out of state with my son who is 6 his father has not been in the picture since he was 1. I petitioned the court but have not gotten a response. I am a little worried that I will not get an answer from the court before we move, which will be on May 26th. Either way I am gonna leave, but I am a little worried about the after effects. I know that the chances of him pulling his head out of his *** are slim to none to become a father to his son. But I also know that if he wants to be a dick and I was denied the permission I could get charged with kidnapping. What should I do?

We were never married, the judge gave joint custody with me having primary physical. He is in jail and has been for 1 1/2 years with 2 counts of sexual seduction, and when he gets out he still has until 2009 before he is off the hook.

Don't leave without permission from the court. I am getting divorced right now in damned Texas, and I may well get stuck with a geographical restriction. So I will be a single mother with no friends or family here at all. (I am from California) If you leave without permission, you will be asking for a lot of trouble, and they could make you come back, making matters worse.

Some states have abandonment laws, where if the father doesn't have contact for 6 months to a year then he is giving up parental rights. If this applies to your situation, file for abadonment and then relocation shouldn't be a problem.

If you were married to his father and not divorced yet file a petition for temporary custody. If you have custody or you have never went to court you should be alright as long as thier isn't a moving clause in your divorce.

Save yourself a lot of wasted money and make no plans to move until you hear from the court. The law is the law.

call the court see where your case is and call for updates daily to make sure they are working on it.

yep kidnapping and its federal offense, you'd be stupid to do it, you should have filed A LONG TIME AGO
