i am English...my husband from whom i am separated almost 3 years is Irish...we got married in Ireland and are legally separated within Irish law...i am now living in England and he has also moved to England to live with his girlfriend...I have a son from a previous marriage...and a daughter from my marriage to him...My daughter was born in England before we were married but holds an Irish passport and we moved there when she was a month old...

what i want to know in a nutshell is whether i can divorce him here in England when we got married in Ireland...and how complicated this could be...would our legal separation agreement count for anything or would we have to start again with everything...if anyone can offer me any advise it would be appreciated...

of course i will see a solicitor...but i just want to know if this can be done from here...Irish divorce is pretty complicated...thank you...;0)

If you are both residents of england, you can get divorced in england... regardless of which country you were married in.

You both were married and legelly seperated under the Irish law. But as you are a England citizen u need to file for divorse here in England, And the legal seperation agreement will hold good in the English Court.

i think your best bet is to go to an english courthouse ans see if they will let u file fro divorce, or just wait for him to file for it. i am german , was married to an american whilst we were living in germany, we seperated in the US and he filed over here and it went thru without any trouble, all he needed was our german marriagelicense. the courthouse can tell u exactly what u have to do. since he has a girlfriend i would wait, chances r he will want it final , that way he has all the running around and stuff to deal with...make sure u put enough rules in about your child, like who holds on to the passport, and how far and for how long either parent can take the child, like don't let him leave england without written permission from u, so IF he would ever take of with your child u had a chance to get her back.............gl

I got married in America and returned to the UK, i petitioned my own divorce from here in the UK.
I am not a solcitor nor brainy..... i phoned my local courts up, payed £1 and they sent me the paperwork to file my own divorce. I didnt get any solictor involved and this saved me £1000's. The paper work is easy, all you need is your marriage certificate and your EX's address. Its worth a shot if it can save you money and you feel better for doing it yourself.

you can defo put a petition in for divorce in england also it will save you alot of money doing it yourself also your seperation agreement will still be in place x x x

Go to your local citizen advice office and they should be able to tell you exactly what to do.
