They're almost certainly illegal to distribute. That's one reason you'll never see a conference distribute the AMVs that they show.
Wikipedia says: "With regard to legality, as has been stated before, AMVs exist in a grey area that encompasses a wide range of current copyright-related matters. Where video content is concerned, most anime makers approve of the fan-made works and many have officially stated their approval of the practice. Where music is concerned, the videos themselves aren't a problem, but their distribution is."
Though an AMV is in some way an original work, it also uses music owned by someone else, and clips of video owned by someone else.
A while ago, www.animemusicvideos.org took down all videos that contained music by several bands (link in Sources) at the request of the bands' record label's lawyers.
One might also argue that AMVs are also illegal to make, though most of the video license holders don't mind the free advertising for their show. How does one obtain the video for an AMV? I can only think of two ways: (1) downloading the video, or (2) ripping the DVD. Downloading the video is violating copyright and the license holder certainly would not like losing the sales that go with free downloads. Ripping a DVD involves defeating the DVD's copy protection which violates the DMCA.

Just to make AMVs is not illegal.....however you cannot SELL or distribute them as your own that IS illegal...........You can sell and distribute them if it is your own video, that you made it from.......or got permission from the owner and or licenser of the video you made the AMV from......but just to make them is NOT illegal.

sure yet they have made them always. I agree is analogous to loading songs onto ur mp3 participant. So get over human beings comprehend that when they make the amv they don't and that i love observing them. I wager you load and acquire issues that are not criminal both. all of us does it really is how the internet works!

in truth yes because they are taking music and videos that belong to others that have copy rights and make it into something they claim to be theirs. Under copy right laws such things as videos and music can not be made to the public unless they have the permission of the owner. Thats why it says when you buy them for privet home use only.
