My ex and I have a child together, and are approximately 4 months into the 6 month waiting period required by Michigan for a divorce. We have been separated for approximately a year and a half. The last six months, I've been dating another man, and now may possibly be pregnant. I've not been tested yet, but want to know the legal ramifications if I am. Can the divorce still proceed? Am I even required to disclose the pregnancy? I don't want my ex to have anything to do with it, as far as his name on the birth certificate, support, or anything of the sort. My boyfriend and I plan to be married, and if the divorce can be final this summer as planned, would be married before the baby would be born. Any Michigan-specific help would be greatly greatly appreciated.

I wish I had a lawyer to consult - I'm using a legal service and filing my divorce myself. My income is limited - my daughter has medical problems and I stay home with her for the time being because she can't be around other children on a regular basis.

Your question is a little confusing but I think I might be able to answer. If you are 4 months into the 6 month waiting period they will not restart the six months because of the new pregnancy. Additionally, you do not have to put your ex's or anyone elses name on the birth certificate. As for the need to disclose the pregnancy I guess I wouldn't unless absolutely necessary.
Additionally - I am from Michigan and had a divorce processed in the last ten years.

I am a bit confused with your question.
So you have a child with your ex and is now pregnant with your boyfriend?
I don't think you being pregnant with your new lover will have an effect on the court proceedings about your divorce. It is your right not to disclose it to the divorce court for it is totally different and unrelated to your divorce issues.
Though you being pregnant and have an new family may affect the court's decision on the custody of your first child with your X-hubby

/Don't even bring it up if you are pregnant. It's none of his business anymore. As soon as your divorce is final, tell him you're marrying your new love. Now all you have in common is your child that you had together. Hopefully you can remain civil to each other for that child.

Go to ask. com and an attorney will help you for approximately $9.00. Request to get advice from someone who knows Michigan law and someone will answer. Don't tell your "ex" ANYTHING !!!
