It was a three lane street I was on, but the officer drew down that it was a two lane street, and the officer wrote down my phone number that wasn't even my number, and he also stated that I was cited for the accident, but he never even gave me a ticket!
I'm going to take the other driver to small claims court to sue for the cost of the repair and the cost of the rental. The accident report says I was at fault, but I wasn't. If I took pictures of the scene of the accident and point it out to the judge and compare it to the report, do you think I will win?

The inaccuracies in the police report are not what matters. It will give question to whether the officer was correct in the belief that you were at fault but it does not prove anything which is what you must do to win your case. You will need a witness to verify your claim of not being at fault. Not being cited would be in your favor too. Find out if the other motorist was. If they were then I believe you have a clear cut case. In Washington even though you may win a case where you are due funds for whatever, the hard part is getting the person to pay as the court only orders payment they do not enforce it. To force the issue is a whole new ball game. An attorney may be your best bet. Many will work free of charge. If and when you receive a settlement they will take a portion of it. The first thing you need to do is contact your local police department and let them know about the descrancies that are on the accident report from what the truth is. Let them know, not only for the purpose of small claims court, but for your insurance, you need an adequate report filed. I am sure that if they have someone look into it, that it wont be an issue and that they can get it fixed. I would however keep a copy of the original report so that you have it for your records, and bring that to court with you, just to back your statement about the days events.

Have you reached the cop that messed up? You should try, otherwise you will be the one at fault.
