Sex is a biological difference in people. (It seperates males and females on the basis of hormonal/chromosomal differences.)
Gender is a social construction of what's "feminine" or "masculine" and has nothing to do with biological parts, but rather how a person defines him/herself.
And, yes, people confuse them all the time. People use "sex" when they mean "gender" and vice versa.

This is a question best addressed by linguists.
In short, sex and gender apply to that which lives - that is, organisms and is simply a way of distinguishing polarity in them.
Underguiding it all is negative, positive, and neutral, which are principles by which all things, animate or inanimate, do abide.
The two are interchangeable and synonymous but not equal but rather proximal.
What communicates best is what imports meaning best. That's all. The varied mechanical professions will use the term male or female to distinguish differing parts for obvious reasons, as evidenced in plumbing or electrical trades, for example.
So again, if it imports meaning and understanding, then the objective is met.

Your sex is determined by your external organs. Male: Penis, Female: Vagina, Ambiguous or Both Sex Organs: Hermerphodite/Intersexed.
Your gender is based on who you are really or the role you play, not who you imagine to be. There are people who are born with the xxy chromosome and their gender can be very confusing to both them and their parents. Most people have heard of XY and XX but not XXY.
The problem is because of pollution and sin in the world you have birth defects where a child could be born with a penis, yet internally is a female (physically). You could have the reverse happen also. You can have a child with intact organs but genetically are the opposite gender. Or you could have a child with both organs but internally or genetically they are one or the other.
Doctors in the past -many still practice this- remove one organ and leave the more developed organ, often giving the parents a choice. That's fine if a parent gets it right or the doctor makes the right choice. The question is, what happens when they are wrong? Doctors use to believe that gender is based on nurture. The truth is no matter how hard people have tried to bring up a child in the role to match their sex they still revert back to their G-d given gender.
The problem is intensified when you consider that many people embrace themselves as gay when they truly have the wrong sex. Family and church reject them because they are practicing abomination. The truth is, their gender can often be scientifically backed up. In the case of those with the XXY chromosome. You've just got to be gracious and take their word for it.
It's funny, my spell check recognizes XY and XX but not XXY.

Sex generally refers to one's biological status of male or female. However, there are and have been intersexed individuals.
Gender is usually a social defintion of how one should act based on their biology. In Tibet, where polyandry is legal and social, a woman has more than one husband and the men perform household tasks. In North America, the female is the gender that attends to these chores.

Gender is a word to describe the words which replace nouns. Mary can become she, Max can become he, the ship can become it or even her etc.
A woman is of the female gender, and can be described as she, her, dear, etc but her sex is always female.
So, yes, we often confuse the 2.
