A business is well within their legal rights to ban smoking on their premises. Employers are not required to provide a place for employees to smoke. My current employer does not allow employees to smoke on the premises while on the clock. This means you could clock out for a smoke break and clock back in afterwards if your supervisor approves such an action. I would guess, since smoking is not a legally protected activity that you just have to live with this, find a compromise with your employer, or find a new employer.

Man that's a crappy place to work for smokers! Bet those 8 hours drag by! Have you tried speaking with the HR dept. about creating a smoking area?

You might just have to tolerate it. A 'burning' desire to do something unlawful is not a handicap or a right. I don't believe there are any jurisdictions in which a company is obligated to make accomodations for smokers. Your best option is to not smoke at work. It might help you to stop smoking at home too, in which case you might not get lung cancer and die. It's a really nasty way to die.
