I believe so .

A cheque is NOT payment = it is ONLY a promise to Pay

"cheque it out" == if you have no funds in the Bank, the cheque will 'bounce' and the Garage will not get their money ...

PS If you think it's illegal to refuse a cheque, how about you give me £1,000 cash and I'll give YOU a cheque ?? (I can assure you that Bank of Toyland is a very reputable Bank and I'm sure has plenty of funds :-) :-)

An agreement between two parties constitutes a contract. However, the intention to create legal relation gives the contract a legal outlook. In the case of petrol stations and their customers, any agreement entered into by the two parties constitutes a contract with legal implication. An important element of the legally recognised contract is consideration. This is the financial commitment of which the party receiving the property in goods must take care of. However, there is no provision by law that dictates the mode of payment for goods or services received. I hope I made sense. Thanks.

Yes.
Currently in law though my understanding is that it is illegal to refuse to take coin of the realm (cash)

However it is also illegal for a Hackney Cab (taxi) to drive around on a Sunday without supplies of water and hay. This law dates from the time when horses pulled everything and has never been repealed.

Can you imagine London Cabbies reaction if they were arrested for lack of hay and water?
Revolution?

Its simply there choice.
A business can decide how we pay them.
By not accepting cheques they save themselves all the hassle of writing the paying book, going to the bank , standing in the Q etc....

Not any longer, there are also plans for them to stop taking cash in some parts. But after all the skimming that's been in the news I hope not.
