It's acually for my mom & her husband. Two months ago they moved in a new house, they are renting. They signed the lease, pay the rent on time, they are good tenants. They just received a letter from ther landlord that they are getting evicted & have to leave the property in ten days bc they have a bird ( one of those small birds you get from the pet store for like ten bucks) & a fish tank ( also not very big). Now in the lease it does state that they can't have small animals like a dog, which they had a teacup chihuaha & had to give away. But nothing a bout fish or birds. My mom thinks she should get a lawyer, which I agree. Can the landlord actually get away with this? Is this legal? Does she have any right? I understand it is her house & they are just the tenants but isn't she being ridiculous?

If the lease states no animals then yes the landlord has the right to evict. However maybe your mom should try talking to the landlord and see if something can be worked out. What if they get rid of the bird and fish for example.

And yes some advice from a lawyer wouldn't hurt usually the consultation is free of charge. Also she should do a search on the internet for the renters rights in your state. As that might be able to help her out as well.

Your landlord is wrong.. If it didn't state no animals of any sort in the lease, she/he can not make them move. And even if she could, she has to give them 30 days. If the landlord does insist, they should get a lawyer. and the landlord should have to pay for the lawyer. I would stay put.

If this is the real reason for the eviction, your folks need to talk with the owner and determine what can be worked out. This appears to be a petty issue.
