We got a call from my husband's 13 year old son last night. It seems his mother is about to go to jail for her 3rd or 4th DUI in recent years. She has been doing everything in her power for years to keep the boy away from his father. He wants to come live with us. We live in Texas, she lives in Indiana, and we can't afford a lawyer in either state!! The mom wants to send our son to Florida to live with her mother, but I think my husband should have first priority and concideration, not to mention my son's wishes. We are calling CPS in Indiana, and child support, but how can we get into court without a lawyer, and from this distance? And how do we do it fast?

were your husband and his son's mom married at any time? if so, what were the stipulations on custody? ask that the primary custody be switched to you, due to her being an unfit mother? was your son with her in any of the of the times that she was pulled over for DUI? if so, that is neglect. is his mother married? if not, who is caring for him everytime she goes out drinking? if you can get the department of children and families involved they usually get things done alot quicker, than if you do it on your own? a mother in florida had a fatal car accident that killed her 7 year old boy, she was drunk and it was 12 in the morning. her other son was taken from her and put into the custody of her father. the boys father has already been proven unfit. if your husbands name in on the birth certificate and he was given rights by the court when they divorced he has rights before the grandmother does.

frist what state is the childsupport and cousty in that is the state that you need to file paperwork in and as far as a laywer goes legal aid most states have leagl aid they provide services cheaper or at no cost depending on your income. does your husband and his ex have a vistation agreement set up if so this can also come in handy because with summer around the corner vistion and durning that time you can get cousty. also talk to child services in the state that he lives.Because if she has been in Jail that many times there is a good chance that they will remove him from the home before she has a chance to send him to her mothers or before you can get a lawyer but if they know that the father wants to take care of him they are more likey to place him with you guys hope I helped

You don't need a lawyer the CPS people will take care of that. It will be just a case of the Judge handing the boy over to your husband and then you should fight for full custody.

At the very least you should consult with an attorney. Usually a consultation is free, or it's under $50.00. It would be worth it to find out your rights. Since she is going to jail. He would have to be placed with a relative or in foster care. Given his age and the circumstances, you may not need a lawyer. Child protective services would be the ones to decide what is in his best interest and since he is 13 and wants to go with you, I would think they would honor that decision.
But I would call an attorney to get some answers to your questions and go from there.
