I got married recently under special marriage act in maharashtra and got it nullified after 4 days . Now, I've a doubt about the validity of the whole process . How can a couple nullify there marriage without giving notice for some time period ? Now, we want to live together but dont know how to proceed , can we cancel our marriage cancellation (or is it divorce?) or do we need to again give the notice for 30 days and remarry with each other ?

- Thanks ,
Veena .

Hello Veenaji, What you say here is not at all clear, if you actually got married under the Special Marriage Act, 1954 before the marriage officer/registrar under section 13 of the Act, do you have a marriage certificate issued by the marriage officer with you with this regard? Or your marriage preformed under any other form got registered under this Act? On what grounds your marriage got nullified by whom? Was the matter taken before the District Court/family court? Was any notice served to the other party for such a petition of nullity filed under section 24 or 25 of the Act? Was a decree of nullity issued by the relevant court? Please answer these questions first to get a correct legal opinion on this issue. Write to me directly all these facts on my email vijay_mahajan5758@yahoo.co.in.

If the marriage was nullified, that means that the marriage didn't exist at all. You would have to get married again. You can't re anything if it didn't exist in the first place.

If you have already nullified your marriage and the time period is up to stop that, then you will have to remarry.

Why don't you go get another marriage license and get remarried? This time don't go for any of those stupid temporary marriage arrangements.
