Hmmm - they will pin it on you. It's your network and it's a pretty foolish thing to have it open and unsecured.
Edit:
Further to the aforementioned, I must point out that this is serious stuff. People can hack your computer via your unsecured open network and use it to store illegal files such as underage pornography etc. You won't even notice! This has happened in the past and was depicted on one of the news shows.... - I'm not sure which one it was, either 20/20 or Primetime or Dateline. They gave this kid 20 years in jail for files on his computer - he claims he has no knowledge of. Based on the type of network you have, if it were my computer, I would do a low level format (Zero Fill) to all hard drives you may have installed. Then I'd start from scratch. It's not worth getting in trouble for other peoples crimes and the way the law works in this country, they'll pin it on the easiest target (meaning you) regardless as to whether the D.A. knows you're innocent or not. Remember - it's just another "good looking conviction" on their resume's.

I agree with Sven B, it's really up to you to secure your network. Yes they can, and it might get blamed on you!
It's not hard to do. There are about 7 settings, each adding a layer of security. Most wireless routers now have a 'wizard' to walk you through the steps, just MAKE SURE to write down the settings, or they might keep you out!
Here's a few ideas:
recognize only your mac addresses.
Change and don't broadcast your SSID
Turn off DHCP so new pc's won't get an IP automatically
Use wireless security like WPA
My favorite: turn off the router when you arn't using it!
Change you admin login and password
Change your IP address

You should research how to setup a secure wireless network, if it is open anyone can use it, and it is your coneection si they will come to you for this kind of activity.
There is approximately 5 neighboors who are running open unsecured wireless networks. How do I know? When I check my wireless network and click computers close to me, all their networks popup. When all the new technology on wireless netowrking and stronger wireless routers, it is a big problem. I doubt these people spent much money on their equipment they just dont know what they are doing and how open they are to access.

If somebody bought a cheap old used computer they got at a yard sale and used it on your network and threw it away afterwards that could be hard to trace unless they left some clues behind like keystrokes.
