i bought a trailer 18yrs ago and put it on my parents land by there home with there permission. the land is theres. we moved out about 10yrs ago and it set empty for awhile then about 5mo ago i rented it out with my moms permission.(dad is gone.) the tenet has paid her rent every month. to me. and i guess she has been paying lot rent to my mom too (not sure) anyway my mom is trying to kick her out now my q is can she do it? i own the trailor but mom owns the land? and if she does can i be sued because she is not late with rent (guess i should have said she is paying to own not just renting) i am not interested in the lot rent part of it just my part as the traylor owner and the traylor cant be moved because they are two of them together. the tenet knows this and was willing to move just the one in a couple of yrs when it was paid off then add on to it again...

the reason is because my adult brother lives with my mom and he is dating/ fighting with my renter

You have one of the uglier legal messes I have encountered. You do not state whether there are any legal contracts covering any of these agreements. If there are contracts, then the terms of the contract(s) would control the answers to your question. If these agreements are all 'handshake verbal agreements', then your mother most probably can enforce an eviction. Absent written contracts/leases, the tenant, as well as you, are tenants on your mother's land. Under most common state laws relating to tenancy, thirty days notice must be provided to the tenant being evicted. If the tenant does not vacate the property in that time, court action can be brought to force the property to be vacated, many times by the sheriff of the county in which the property is located.

Your mother can evict you as well as the other tenant, since you are basically renting her land without fee.

Since I am not a licensed attorney, I strongly suggest that you seek qualified legal counsel to guide you in this matter. If you are able to amicably reach an agreement with your mother, then DO take the time and spend the money to have a proper legal contract drawn up between you and your parent which will clearly state the nature and time frame of your tenancy on her property.

Yes she can make her move without your permission. By law if she wanted to push the issue she owns the trailor because you abandoned it on her property for 10 years. Your mother can take you to court and also make you pay for the time the trailor has been on her property. The moral of this stoty is not to anger her and let the tennant go, next time move in a ugly girl that your brother would not want to date.

In this case the tenant rents the trailor and the land under it...so yes your mom has a say in where the trailor goes.

If your mom says get it off her lawn she can do that.,..and yes you would be liable for damages.

Unless you have a written lease...then you have a month to month lease...ask your mom to give her 30 days...if you tell the tenant to leave in 30 days you are in no trouble what so ever.

Your mom needs to take u to court saying she wants the trailer off her propert then u will be given X amount of days a to move the trailer THUS making U foreclose on ur tenant! Lot rent trlr rent should all be in writing!

If your Mom never deeded you the Land, then Legally it is still her Property and yes she can have them evicted. If you make her Angry she can force you to Remove your Trailer Homes. You may want to see if the Buyer to your Mobile Homes, can afford to have them moved, because it looks like that is the only recourse you/they have..You can not be sued by the Buyers, when they knowingly bought the Trailers from you and knew the land was your Moms..

I would think that your mother would have to kick the trailer off from her property.She doesn't have anything to do with tenent.So i beleive it would be the trailer even if she is paying lot rent to your mother.Would your mother actually make you have to move the trailer.Because if you break agreement she may be able to sued you.

The trailer is on land that does not belong to you. Your mom can do whatever she pleases with her land, including kicking out the tenant living in your trailer.

Don't know what state your in but you need to check out squatters rights
Have you talked to mom about why she is doing this?
