I am wondering if someone could help me with some answers ? I have been married for less than a year and want a Divorce. The only thing I am afraid of is my truck. We bought it from Sam Swope less than a year ago both of our names are on the title. He sold my grandfathers truck for 1500 which went toward the down payment on the expedition. The payments are behind a little , but what has been paid was all paid by my grandmother and grfather. She keeps all of that info. in her check book where she wrote out every payment and amount. Will I be able to get the truck for me and my children beens he never made payments and is he legally aloud to drive off with the truck anytime?

Being as the truck is in both of your names who makes the payments really doesn't matter..

You can file for divorce asking for the truck as a portion of your settlement.. If he contests the judge will look at the needs of both parties and decide what an amicable division of property will be... (Giving up other property volunteerily especially property of equal or more value can make it more likely but not guarenteed that you get the truck.)

As of this moment you are still married and the truck is legally in his name as well as yours.. He can drive it off just the same as you can...

If his name is on the title, it's his truck, period.
you can ask a lawyer, but I think I'm right. but please ask a lawyer or ask a question in the legal section of yahoo answers.

There are times a separation may be warranted like if he's abusing you or something. But there are very few situations where a divorce is ever warranted. Unless he's been cheating on you the entire time you don't have any grounds.

You haven't even been married a year and already want a divorce? Is he abusing you or something. You should really try to work things out, or consider not marring again.

Marriage isn't disposable, its for life.

if your grandmother has the info in her checkbook, there should be no problem if you say he hasn't made any payments.
