Where I live the fence is considered the responsibility of both equally. Now if one has a pool and the other does not, the responsibility falls entirely on the person with the pool. We had a situation where the fence was coming down behind us, they had a pool, we don't. Since my hubby is very handy outside, they said they would pay 75% if we would do the labor. I checked with the city to make sure before we approached him, and I was correct. Because of safety, a person having a pool is fully responsible to maintain a proper fence completely surrounding the pool. If no pool or both parties have one, then you would need to split the cost. If they aren't in agreement, then you could do it and take them to court for reimbursement of their share. I live in California, and I believe the law is the same for the whole state, but not sure. Actually.... you are responsible for the fence ONLY IF the fence is inside your property.

A lot of the time, fence are placed with the horizontal member facing toward the party who owns the property and the fence. In another word, the nicer part of the fence is facing outside.

Legally, regardless of who put the fence up or which way it is facing, if it is not inside your property line, you have no responsibility or rights over the fence. If the fence is inside your property line and you didn't put it there, you can ask the party who put it there (and even demand) to remove it, or you can destroy it yourself, since it is considered a gift.

Also, legally, if you don't own the fence and it is not in your property line, you have no responsibility or rights to paint or maintain the fence. It can even be considered defacing the fence if you paint it, and the owner objects.

Usually thought, issues like this are agreed upon casually between the neighbors.

You are never responsible for a "Side" of a fence, but the whole fence. It will show on your deeds who is responsible for which fence but a good guide is the owner has any posts on his/her side, If it is a panel fence with the posts in line with the panels, ignore the post advice. Look at your deeds is the answer.

It's USUALLY the right hand side, as you look out from the house, but it's certainly not 100% that every house is like that.
You would need to check on the deeds for the house.

You would normally say your side. However if the fence is not on your property at all (check your deeds) then you are not responsible at all.

If the fence posts are on your side,It is your neighbours fence.

iam pretty sure its the fence on your right,just depends how you get on with your neighbours, i get on great with mine on both sides, so we tend to both?if in doubt check your deeds but sure its the fence on the right?
