This hypothetical example: A young man, Charlie the home owner, is renting out two rooms to other young men Harry and Ben. Ben is a serious drug user and dealer, from Marijuana to Cocaine, is only in the house two days a week and keeps a large amount of drugs in his bedroom wardrobe. Charlie and Harry know about this, they are not dealers themselves, but do dabble in drugs, mostly Marijuana and Ecstasy. During a noise complaint the police are called and find a huge stash of drugs in Ben's wardrobe. Both Charlie and Harry deny any knowledge of this. In Perth WA law, where do Charlie, Harry and Ben each stand?

It depends on what the authorities want to do. They could claim the home is paid for with profits of the drug trade, and try to get a court to declare a forfeiture. They may or may not succeed in the forfeiture, but by the time the homeowners ultimately win, it'd probably be in foreclosure anyway since no one would be paying rent on it.

I'd like to see the Democrats introduce a bill requiring us to start pulling out of the War on Drugs. It's been 40 years, and we aren't any closer to winning it than when we started. Time to admit we lost and do something else with the money. Oh, they kicked in another innocent person's door the other day, and she was armed. She'll be charged with assaulting the police who had no business there, I suspect.

They stand out on the front lawn, because the government has just seized the house as property used in the illegal trafficking of narcotics. And that's federal law, doesn't matter where in the US they are.

Of course, since they both probably have some in their pockets, for their "personal use", they probably wouldn't be standing anywhere. They'd be sitting in the back of a patrol car in handcuffs on their way to jail.

If Charlie wanted to keep his house, he should've kicked Ben out on his criminal a** when he found out what was going on.
