It usually is decided by a judge unless you and he can come to any type of an agreement. If she is old enough to make that decision, than you have no problem. Most times the Mother is awarded custody of a child.

You go to court and ask for custody of the child, if the child is old enough the child will get a say in where she lives. If not the judge will determine what he/she feels is best for the child, not just what the child WANTS.

If there are no bad reason to keep the child from either parent, the courts will always choose 50/50 custody and courts will force you to work out an arrangement program for visitation.. If you can not agree the courts will make one for you

Most of the time the mother is granted full custody of the child. You really didn't give a lot of details but in most cases mom gets custody but you may want to seek legal advice about this.

Then you make sure that she lives with you, if your a wonderful and stable parent. This child is suffering because your obviously getting a divorce right now. Don't let her suffer more for your mistakes. Do anything to make her happy at this time.

Let her, but she has to pay rent, and her share of the utilities and food. If she gives you problems, ask her to get her own place.
