First he or she is arrested.
Then he or she must appear in court to the charges and enter a plea.
When the judge hears the testimony from the husband or wife such in this case I am speaking about, the judge will then set bond and this takes place about three days after the arrest. By law you must appear within 72 hours of the arrest.

So if your arrested on Friday night, you will have your court appearance on Monday.

Now once bond is set, you can then bond out of jail.

If the Judge feels that your crime is violent and the wife appears in court crying saying to the Judge that she doesn't want him out because he might kill her.
He will remain in Jail for at least 30 days before bond is set. This is called a cool off period.

The longest you should spend in jail for Domestic Violence charges is minimum three-days with bond.

The Judge may also put a stipulation on the bond that you are not to go near your wife or husband in this case for at least 30 days or you forfeit the bond.

Domestic Violence is not in the hands of the State and they bring the prosecution regardless if the wife or husband refuses to testify in their behalf or for the other to prevent incarceration.

It is a very bad consequence for Domestic Violence.

In some cases not all just some cases the judge will drop the charges and aquitt the defendent, but there has to be a good cause shown that he or she was not actually a abusive person and what occured was merely an accident that is a 100 to one odds that the Judge would buy it, but they do some times.

Today, the law works very simple. Whom ever makes the call to 911 about an argument receives the benefit of the doubt since they called and are not likely to go jail.

So if the wife yells and throws a book at her husband and hits him in the arm and it doesn't hurt him at all.....he calls 911 and say;'s my wife abused me and threw a book at me. The Police show up and take the wife to jail.

The Golden Rule of Thumb for all couples is not to argue at all about anything. Do not yell. Do not holler. Do not throw things in the house.l Do not destroy the others property.
These are all grounds for incaceration of the person guilty of these crimes when it comes to Domestic Violence and yes tearing up her shirt in the closet is a crime or breaking her dishes during an argument is a crime.

Depends on the state you live in. There are different time frames depending on the state. Personally from experience they do not keep them long enough or at least they didn't when I went through it. He was only in for a few hours. Free as a bird the next morning and returned home. However, I think the law has changed now.

Babydoll I was raped and almost killed by 3 guys and 2 of them got out in 3 months the other in 6 months it just depends I guess on the state laws

i think it all depends on the state you live in, here its 30 days or a fine paifd in full then they let you out, its all about the $$$ for the goverment ya know, you just dont want 3 domestics here or its a felony!

For a first offense usually not long at all. But it has to do with what he did. If he hit you then probably not long at all, maybe a weekend. If he stabbed you then he might do some serious time.

Depends on where you live. Sometimes it's as short as over night. Other times, they can only get out if someone posts bail (and why does the battered spouse do that..ever?).

It also depends on the injuries.

Depends if it's their 1st offense or not, if they're on probabtion or parole at the time of the offense occured and unfortunately they never stay in long enough.

If in india then no more than 1 to 2 days.May be more faster if u pay bribes to d police.All business man! U can buy law now.

depends on the state and the judge. they may get out the next day but at their court hearing have to stay awhile

Until their court hearing and then the judge decides if he has to stay longer and how long that is.
