Two years ago my husband and I separated, but never divorced. Together, we have two kids. In Aug 05 our children went to live with him as I had no place at the time suitbale for them. I was visiting them at my parent's house 2 days out of the week until Oct 06. In March of 06 my boyfriend and I got pregnant. In Oct. I was on bedrest, waiting for baby and keeping my other two children 4-5 days out of the week and still obligated to pay child support (400/mo). My new son was born in Nov. At a recent court date, the judge seen that I kept my children 4-5 days out of the week for 6 months and planned to continue doing that, but did not termintate the order. Back pay added up during pg. If I do not pay every penny of current support between now and the next court date, I will go to jail. Unlikely support will be terminated. About to lose place to live. Only way to support new child and these children is to give my part of the custody to my parents of my two oldest. Can I?

You can try but the final decision will be up to the Judge. The worst he can tell you is no, but worth a try. Dad will have a say so in this too. The Judge will do whatever is in the best interest of the kids above all rest. You may have to show that your parents are the best choice in this situation. Im not just sure how this got so bad out of hand so its hard to tell which way the Judge will decide, sorry. You will probably have to show that your parents are a better choice than their father. Good luck

Why ought to your ex-husband get carry of money for the youngster? once you are the extensive-unfold custodian - in case you have extensive-unfold actual Custody of the youngster then if there is any income the kind of a help order then you definately will get carry of it based on the court docket's order. If the youngster is on your husband's medical plan then which will proceed besides. Your husband ought to be waiting to point you if he's getting kin pay and if so then you definately ought to verify that your baby is risk-free on that allowance. Joint custody generally potential greater effective than actual custody and it refers to creating judgements for the youngster like medical, academic and spiritual judgements. i could anticipate which you have the extensive-unfold actual Custody and your ex has Partial Custody.
