when is a ex-spouse entitled to a ex-spouses military pension

I understand the ex spouse gets 50% of the pension for the number of years the spouse was married to the pensioner while he/she was on active duty. So if you were married to him/her for 10 years and he/she was active 7 of the 10 years, you get 50% for 7 years. Of course this is still negotiable and can be bought out or agreed to a lesser amount in the divorce petition.

when the military member is a man, the female ex spouse is entitled to the pension.

when the military member is a woman, the male ex spouse is told to f*ck off and make a living like a REAL man.

that's not exactly true, but it's the prevailing attitude in our culture today.

It depends where you live and where he lives. There's a reason why OJ moved to Florida, it's because they do not allow legal judgements against ones pension. Other states will force an equitable split, based on how long the marriage was together and how much each person might need to live on. You will have to check with a divorce lawyer in your local town.

If they were married 15 years, then the ex is entitled to a portion of it. If less than 15 years, no.

sure, they are entitled on your pension. the way they distributed the money is over the years you've been married. in case you've been married over 2 many years she is entitled to 0.5 of your pension.
