Definitely !He laughed instead of stoping and commenting to his fellow at that time ! He surely is equally responsible for this incidence but one thing is to be kept in mind that even on any such comments it would be difficult not impossible for any one else also except to laugh ! So better you give thought to understand that second fellow a 100^ guilty or rather equally to first one ! He may be a gentle man but because of instant stimuli he gave that laugh ! Any word, gesture or act intended to insult the modesty of a woman is an offence punishable under section 509 of the Indian Penal Code 1860 as:- Whoever, intending to insult the modesty of any woman, utters any word, makes any sound or gesture, or exhibits any object, intending that such word or sound shall be heard, of that such gesture or object shall be seen, by such woman, or intrudes upon the privacy of such woman, shall be punished with simple imprisonment for a term which may extend to one year, or with fine, or with both.
Also section 294 of IPC provides obscene acts and songs
Whoever, to the annoyance of others-
(a) Does any obscene act in any public place, or
(b) Sings, recites or utters any obscene song, balled or words, in or near any public place,
Shall be punished with imprisonment of either description for a term which may extend to three months, or with fine, or with both.
Such an act, facts of which you stated in your question are covered by both these section hence the person will be charged with section 294 read with section 509 of IPC.If the friends were involved in the act as mentioned above they can be also charged under these sections read with section 34 & section 109 of IPC for their involvement. Both the offences are cognizable offences hence a FRI can be lodged with the police or a criminal complaint even directly to the first class magistrate for the said offences.
