i am a self employed single dad and wrote a check that went bad..i got an extension but it is about to run out on me.this has never happend to me and im told i could go to jail till it is paid..i have until tuesday and its not lookn good...i know i owe it i want to pay it what should i do if i cant make good on it by tuesday ?

You probably will not be sent to jail. However, you should be aware that writing bad checks is a criminal offense. In most cases, it is a misdemeanor, and many states have a requirement that you be notified in writing before charges are brought. In many states, the payee has a right to charge you a fee of about $20 for dishonored checks. You may have seen signs in stores to that effect.

It is best to sort out matters with the payee of the check. It is inconvenient if a criminal complaint is filed and you get hauled in front of a judge or magistrate. You can avoid a world of unpleasantness if you can settle matters before they go that far.

I believe it is against your constitutional rights to be jailed for debt. debters prizon was abolished. They can however, charge fines out the wazoo and make all kinds of threats, take you to court etc... Make life as misserable as possible.
As long as you make a payment every 30 days and they accept it they cannot do anything as far as I know. Back in the 80's my husband was self employed. We bounced a check at Domino's Pizza. Check Rite's Attorney fined us over $200.00 for a $17.00 mistake. We offered to pay the $17.00 pluse the $20.00 bounced check fee. They would not accept it. We were summond to court where all they did is take information.Then within 1 week they came and took my car while my husband was out of town. (By the way, they threatned to put my husband in jail too. ) I had a friend who was an attorney call and read them the riot act and I got my car back the next day. They will try anything playing upon your lack of knowledge and fear. I sugest you find out what your rights are and fight back.

Simple... Dont write bad checks in the first place, What more do you need to know?

Go back and talk to them again. In the meantime, do you have anyone who could float you a loan?

take your kids and move to norway... cause we dont use checks, so there wount be a problem!

checks are so 80's anyway.. so why bother?
