my brothers appointed attorny is doing nothing...how can i get a different appointed attorny?

Unfortunately I have been through the court system enough to know exactly what you need to do.

Inform the Judge about the incompetent Lawyer and that there is a conflict of interest.

Every state in the USA has to give you an unbiased attorney, and all you need to do is say that this lawyer will not defend you or that there is some other problem with the lawyer.

I assume that your brother has no job, hence the reason for a court appointed attorney. Your brother still has rights, and the lawyer knows it.

Dont let him take a plea tell the lawyer what you want out of the case, if he wont do it your way.
ITS A CONFLICT OF INTEREST.
Remember just because he's court appointed doesn't mean he's free, a lot of these court appointed guys are working from out of town, and most are new to law.

They get paid if they win or lose, if they get you to cop a plea (drop charges for a guilty plea to another charge)
They get paid just as much if they work your case and get you off.

He...not you...can ask the judge to appoint a new attorney....but unless there is gross negligence this is usually rejected...and it takes alot for a judge to find an appointed attorney grossly negligent...he practically has to come in drunk, fall asleep, and insinuate you are guilty.

It's up to your brother to ask the judge for one. If he can prove he was badly represented by a lawyer then he has potential grounds for a mistrial.

On the next court date ask for another one.

I would do everything possible to make the situation known. It's a really horrible system.

Ask the judge. Maybe he will get a new one and maybe not.
