I would like to organise the paperwork etc myself if possible - to save money.

** Most terms ** for a divorce have already been negotiated with the terms of the separation. These terms can always be revisited, but is usually good groundwork to see what is working and not working. IF both parties are in agreement to get divorced with all things remaining equal, this should go quickly.

Every state has different requirements and procedures for obtaining a divorce though they are all similar in some ways they are very different in others. Go to the Clerk of the Courts office for Family Court near you and they will provide you with all the information you need including forms and how to proceed. You will have to have your husband personally served with copies of the Divorce Complaint unless he is parts unknown and if he is the procedures become complicated sometimes. You might want to consult an attorney, usually you can get some answers during the first meeting and many attorneys will not charge you for an initial consult - but ask FIRST!

IT's possible probably depending on the state, but my sister-in-law did that with her first marriage and it ended not being the best route to take. You'd be better off to hire a lawyer, even if it is one that could represent you both if you can get along well enough for that. And is this a legal separation or just a mutual one??? Some states require a certain length of legal separation before you can file for divorce.

I've just done this.

Go to http://www.divorceuk.com/pages/keyissues/diy.php and download all the paperwork and their guidance. If you would like a little more help, try http://www.justdivorce.co.uk/, it doesn't cost very much and you can be sure you are getting it right (although it's not difficult).

There are also a lot of websites offering really useful information.

So long as your husband signs the forms with no quibble and sends them back, it's plain sailing. It took a total of 4 months for mine to go through.

I'm in the same boat. I guess you can file a "legal separation agreement" and then be separated for a year and when you file after that year is up you get an automatic divorce. But, my husband and I didn't file the separation so I'm kinda stuck. Good luck!

you can start by going to the courthouse and filling out the paperwork, and then if you have lots of issue to resolve, house, kids, child support, you can hire a laywer if you think one will be necessary. You don't need a laywer to file the paperwork, you pay $150 a hour for something you can do yourself for free. If you have no big issues you don't need the laywer at all. I did mine without a laywer and came out fine because he didn't contest anything.

Are children involved? Is this an uncontested divorce? If no children are involved and it is uncontested.. it is cheaper and easier to do it my publication. Contact your local Clerk of Superior Court office to obtain the correct forms and procedures needed to file a uncontested divorce by publication. Tell them that you want to represent yourself (Pro Se). The go online and search for a PROVE Up SCRIPT for divorce to have a guideline on what to read the day of court. And Boom, it is DONE!

If you filed a separation agreement with the court prior to splitting, in most states that document becomes the basis for your divorce judgment. If not, then you really do need to seek legal advice. I concur with others here - you must be in TOTAL AGREEMENT on everything, and, as importantly, be able to rationally discuss those things that you need to iron out. If kids are involved, PLEASE, PLEASE get legal counsel. There are many teenie little things the regular lay person won't know, and it could turn out to be unfortunate for your kids down the road.

Depends where you live look in the phone book for divorce clinics that can do everything for you all you have to do is send them the money and sign a paper its usally about $200.00 or go to the court house in your area and they can give you all the necassary paper work you can file yourself and its usally alot cheaper.
