I am doing some research for a written piece. Has anyone heard of any similar cases and at what gestation was the baby?

Thanks for all the answers so far. In the case I read about the doctor was the girls father and he didn't realise she was so far on in her pregnancy. I don't know how he could make that mistake but it was quite a while ago.

Thank you soo much for putting this subject.. You save my babys life. I have two lil ones and now pregnant again and I didnt know what to do I really was thinkning of abortion but then i know it was wrong. I read all these websites and theres no way im going to put my poor little angel through all that pain and regret it for the rest of my life. Thanks so much i made a appointment to see the doctor today for my first check up .... Well I guess I'll be having three kids now!!

Yes, that happened in Germany. That was the only one I had heard of. She sued the doctor and he is required to help her pay to raise the child. I don't recall how much the amount was, but the attempted abortion was performed during the first trimester. I believe the doctor simply botched the job. Try to google it using the words "woman sues doctor failed abortion" or something like that. Good luck on your research!

There are circumstances (in the UK, not sure about USA) where an abortion can be performed up to 22 OR 24 weeks. However, with new technology, a baby born prematurely at 22 weeks has a small chance of surviving hence the argument to review abortion times in the UK.

Be careful in your research to differentiate between healthy debate and differences in opinion and radical pro-life scare-mongering.

I have heard of a case, the girls name is Gianna and she has a book out about her (can't recall her last name, sorry). Her mother went in to have an abortion where they basically try and burn the baby to death with some kind of saline and something else solution (this was back in the 70's). She survived and was born with various disabilities. She is an amazing story, she speaks around the country.

Ive never heard of it happening, but i suppose there is a remote possibilty that it could happen with a late abortion, i mean, you can abort up to 24 weeks, but ive heard of women naturally going into labor at 22 weeks and the baby has survived.

This does happen, but not in the way that you're thinking of it...it's not the baby, really, it's more just the tissue. It's an incomplete abortion, essentially.

It only happens in about 1% of cases, so it's extremely rare, but it requires a D&C to get out the rest of the tissue. This would usually occur with a spontaneous abortion (miscarriage) or when RU486 is used. Potentially, if all the tissue wasn't taken out, it could continue to grow, but not in the sense of a "baby", rather parts or tissue.

NOTE: I see what you're getting at now...the wrongful life suit....type that term in your search and you'll find what you're looking for....

I was early, my death was not expected to be seen until about 9 a.m., when he would probably be arriving for his office hours. I am sure I would not be here today if the abortionist would have been in the clinic as his job is to take life, not sustain it. Some have said I am a "botched abortion", a result of a job not well done.

There were many witnesses to my entry into this world. My biological mother and other young girls in the clinic, who also awaited the death of their babies, were the first to greet me. I am told this was a hysterical moment. Next was a staff nurse who apparently called emergency medical services and had me transferred to a hospital.

I remained in the hospital for almost three months. There was not much hope for me in the beginning. I weighed only two pounds. Today, babies smaller than I was have survived.

I have heard of this happening many times. The sad part is the women ended up suing the doctors because the procedure did not work. These happened during the 1st and second trimester.

Many of the pro-life organizations will have stories about "failed" abortions, from the men and women meant to be aborted. I remember one story of a woman whose mother I believe decided into the abortion that she didn't want to go through with it, and the woman was born with only one arm because the doctor had already started. There are plenty of stories on the web.

I think I read about a woman in UK who was left with one twin after a termination. She sued the health trust I believe.

The remaining baby was fine (has grown into a normal kid now I think).
