Of course you don't go to jail for adultery! But if you want to be with someone else you should get a divorce first.

My understanding of adultry laws is that adultry is not punishable by jail time, rather it is a reason to give the court in a divorce action.
What are the divorce laws in your area? I can only speak for Ohio, but Ohio (a some others) is a "no-fault" state. That means the court does not care what reasons you have for a divorce, just as long as the assets are split amicably.
Some states, however, still have adultry as a mmeans for divorce and if that is the case where you live, the courts will frown on having an extra-marital relationship, no matter how long you were seperated. Legally, you are still married until the papers are signed and that is all the court cares about.
I suggest you speak to an attorney in your area to get the real scoop as to what you can do.

Technically if you are sleeping with another woman before the divorce is final then yes you are committing adultery. No jail for that as far as I know. Your wife has committed adultery if she had/has a boyfriend before the divorce as well. You also have the right to see your children on a regular basis, and the right to request that no overnight visitors of the opposite sex be in the house when your children are present with the exception of a remarriage.

She left you! She was the one who was committing adultery!
It has been a year and a half, and she didn't come back, you have every right to go ahead and move forward with your life!!
No judge is going to condemn you to jail, sounds to me like you are doing what you need to do, taking care of the childrens financial obligations, attempting to see them, etc.
If there is no reason that you should not be allowed to see the kids, and she is denying you visitation , she will only look bad.

NO...nothing will happen to you. Even if your a son of a biotch...what will happen is IF they can prove you have a "g/f" and NO divorce had been filed yet...the judge will snub you. Thats all...NOTHING more. Relax...she can't get more than half NO matter how bad things were or are now...if you put any restrictions on her just remember she can put the SAME restrictions on you. Just split the assets evenly, agree on visitations, and get on with your life. The more time spent on revenge the less time spent on your g/f. Makes for a very troubled life style...trying to ONE up each other.

Legally sepaking, once your wife left and hit legal aid to have papers drawn up - having a girlfriend is not grounds for adultry. She could try, but your lawyer should be able to easily extinguish this. Make sure that you are in a position to support joint custody - meaning only that you have financial security, no inapporpariate persons or activities in your life & then DO NOT quit! Fight as hard as must to be a part of your childrens lives if that is what you truly want! God Bless!

oh boy,this sounds kinda silly but if you have a girlfriend and wife has a boyfriend,ya both committing adultery and no ya don't go to jail,just get divorced and move on,as for seeing your kids take her back to court,you have every right to see them and be in their lives.

Let's see, your wife left you because of a boyfriend, won't let you see your kids, you have a new friend and you are worried that you've done something wrong!!! Get yourself a good attorney and be free of this woman so you can move on with your life.

Since she originally left due to a fight over "HER boyfriend" now that you are separated for a year it is irrelavant wether you are dating or not. Since she was dating before you were even separated. Sounds like they are going to play dirty games in your divorce to get what they want, your wife and her mother. If I were you I would find myself a good lawyer and make sure I don't get screwed.

no, you have been separated 18 months, hasn't your divorce come through yet. i cant the nerve of her mom when it was her daughter that went off with another man, so go for it with this new girl, hope it works out with you. get a solicitor to get the the divorce through if it hasn't done already. good luck
