The difference is found in one of those technicality "loopholes" that lawyers love, but normal people get so frustrated by. I'll try to explain:

- First, it has to be stipulated sex in of itself is not illegal. (Some sex acts, in some circumstances or in some places, yes, but having sex is essentially legal).

- Allowing someone to have sex with you for money (or paying someone so that they will let you have sex with them) is illegal in every U.S. state except Nevada and much of the world.

- Filming or photographing people having sex is not illegal unless it is prohibited by law in whatever jurisdiction you live in, but, much like sex itself, filming or photographing sex is essentially legal.

- It is also not illegal to pay someone for the rights to their image, or to photograph or film them with their permission (and to compensate them for it).

THUS,

- A porn actor is not paid by the people they are having sex with, thus, neither actor is paying the other to have sex with them.

- They are getting paid, however, by a third party, for the right to film the sex they are having, and distribute that film. While they are not getting paid for the sex itself, they are getting paid by people willing to pay more for a picture/film taken while they are having sex, than they would get paid for, say, a candid of them doing a crossword.

- The sex is technically voluntary and consensual (not coerced by promise of payment), but the money comes from signing over the film and distribution rights, the same as any actor, model, or reality TV star gets.

HOWEVER,

- Paid filmed sex isn't necessarily legal everywhere. If a local ordinance or state law prohibits filming sex or paying for the rights to film sex, then it becomes illegal, and only an appeals court/supreme court decision (such as the one in California that protected L.A. county's right to make porn) could overturn a democratically passed law.

Because porn production companies and their employees (including porn stars) pay taxes, where as prostitution doesn't. Porno honestly is over glorified prostitution. I am not against porn, I am just stating the fact.

Porn stars are not arrested because they only show their bodies and do not allow others to have sex with them publicly. Thus, they cannot be arrested for prostitution.

Pornographic movies, while they look real, are simply acted out, and they aren't really engaged "in the act" technically, so they aren't considered prosittutes and there isn't any law against that.

Because both parties are "actors". Both are getting paid to make thier f**k flick. You can't get much further from prostitution than this.

Because as long as the government gets it's cut they don't care what you do. Says a lot for our leadership.

Because the peope having sex in a porno are not paying money, they are getting paid.
