The driver wants to sue me for negligence, as my dog broke through the fence and got out. She was looking at a possum on the electricity wires and hit my dog. I want to know how I get proof of the alleged damage to her vehicle? She says its $1071 worth. When I looked at the car the day after, there was no visible damage.

She wrote me a letter, and wants me to pay her the $1071 or whe will take me to court. Should I respond to the letter, or just let her take me to court?

If she was looking up at the electrical wires, she hit your dog through her negligence. I would consult an attorney - Legal Aid is free - and pay nothing. Let her take you to court. If you already know that she wasn't even watching the road, then she will have a hard time proving that you were the negligent one. She - and you - are lucky that you were not in the road!

Okay, let me get this straight... She hit Your dog and actually is trying to put the blame on YOU???? What if had been a toddler that suddenly found out how to open the screen door, then wandered into the street and this person hit the toddler... Would she blame you?? Obviously she wasn't looking where she was going or driving careful enough on a 25 mile per hr residential neighborhood where families with kids and animals etc...live !!
I think that I would tell her to take a hike and if she actually did take you to court I'd certainly be surprised if the judge actually agreed with her. That's the only way she'd get anything from me !

o hell no you should not even be paying him an animal is an animal and you cant control them, for anything you should sue him for emotional damage(considering you did love your dog)
and its not like your dog was juz loose running around it broke though a fence and escape dont pay for his car at all tell him to buy you a new dog, besides how fast was he going for the damage to be up to $1071, and what type of dog did you have unless it was a saint bernard i doubt it would do so much damage

Ask her to produce the detail estimate from a body shop, and insist that she bring the vehicle to a body shop YOU trust as well (you'll pay for the inspection, which would take no more than 15 minutes and negligible cost).

If she refuse, say it's required by your homeowner's insurance. If she still refuse, give it to your homeowner insurance to shoot her down. Insurance companies are experts in shooting down frivolous claims.

I don't blame the driver . How could you be so thoughtless not to have taken every precaution to secure your dog . You are talking money.. and you are responsible for the suffering of an innocent dog ? Whatever you do - don't get another dog . Have the driver get a written estimate for the damage . .I'm surprised she isn't suing you for the trauma alone . Dogs are like children..they need responsible supervision .

Let the driver sue you in court. Let the court settle it. Pay nothing.
