Nothing protects smokers.

It's a habit. If it interferes with anyone's enjoyment of their home, it can be forbidden, even if done in one's own home.

Oh well, you could always quit.

The Fair Housing Act protects people from discrimination based on sex, race, religion, color, national origin, ect... no law that I am aware of prevents one from discriminating against smokers.
I am unsure what rights you would be referring to, but again, the Act is a part of the civil rights act, which prevents discrimination based on various things as those listed above, but has nothing to do with smoking or not smoking.
