i lent my car to my cousin while i was deployed in iraq, he and a friend were caught with 2lbs of marijuana, my car was impounded, and now they are saying my car could be taken from me, what are the odds of the authorities keeping my car?

Their procedure is to seize all property involved in the crime when it comes to drugs.

Yes it was your car. But you gave permission for your cousin to use. In giving him permission, you gave him the responsibility of the vehicle as well. So that means that if it is used in the commition of a narcotics crime, it could be kept for good. That is the law in some states. But each state differs.

I would contact a lawyer and enlist their assistance. They may be able to get you your car back.

Well, if it's impounded then it's racking up charges by the day. I have three suggestions for you.

Seriously though, odds are your car is getting hit for around 40-100 bucks a day in impoud so it won't be long before the charges are greater than the value of the car. The law is simple though. If they were in possession over a certain amount police can impound and take the vehicle leaving you with the fiduciary responsibilty remaining on your shoulders.

The car could not be taken but can only be impounded since the drugs was found therein. However, after the termination of the case, the car will be returned to you.

The car can be seized, in any case involving drugs they can keep assests involved in the crime no matter who it belongs to. They take alot into consideration though so I would write a letter to the police and judges involved explaining the case. They will probably release your car to you or a family member with a clean backround. I have seen a case though where a bed ridden man allowed his son to live in his home, his son deceided to grow marijuana in his basement without his knowledge, and even though the man was bedridden and unable to have gone downstairs to become aware of the situation they seized his home arrested his son and charged him as well. He was maintaining a drug house. The charges were dropped but the man lost his home and all of his possesions and was forced to live with a relative. It is sad how our criminal justice system works, but it is how it is. Good luck.

With 2lbs of weed they might just keep it.

It's really up to if the judge is in a bad mood that day or not, since it's your car.

If you can prove that you were not the driver of the car at the time of the incident, then they shouldnt really keep your car, however expect it to be damaged as they may well have searched the inside for more drugs, by cutting lining, moving seats and ripping them open etc.

go get it from impound, you have a fee to pay to get it back.

if they keep it, their is a reason, so find the reason and then get your car back.
you will also have to prove you were not home when the crime took place.

NEVER lend out your car, if you leave for 8 years still do NOT lend out your car.

You lent your car to your cousin. You knew it was in his control. Say goodbye to your car unless you can convince the DA, and the DEA that your cousin stole your car..

I think 2 lbs. can get the "intent to sell" added to the charges; you'll be lucky to get it back. Good luck getting your car back and thank you for keeping me and my family safe and free.

In IL. it is 100% they keep all vechicles that are involved in drugs. No matter how much or little was found.
