My husband and I are going to court to get custody of his daughter. Her mother had an old boyfriend arrrested for breaking in to the house. Now this guy is back in the picture and is going to court...(to say what i dont know) But I have a feeling if that fact about being arrested is brought up, they will deny it. Is it possible to get a record or a copy of a police report if we are not part of that case?

There are a few ways you can obtain this information.
1. Go to the police station and file out the paperwork requesting the arrest records. This will usually cost a min fee.
2. Some counties have computers in their courthouses you go type in the person of interest and not only will you find out about that arrest but you will find any/all arrests made in that county, and the outcome of the arrests. If you want to print the information out usually cost 1.00 a page.
3. Pay 35.00 and have a background check done on him either at the State Police or a private agency there locally but they will need his SS number which I have a feeling you probably don't have.
So I would recommend either 1 or 2, remember this is public record.
If you get the police report from law enforcement take that case number to the court house and ask them to pull the file and review it this is usually free unless you want copies of it.

After reading a few other advise you got, DHW does not do background checks on just anyone. GAL's (guardian ad litems) are appointed by a JUDGE they are not just up for sale.
If this does go to a court battle and you are in family court you can ask the judge to order a guardian ad litem. GAL's are a third party opinion given directly to the judge. They look at the whole situation and gives a recommendation of what is in the best interest of the child.
Try 1 or 2 first.

In most states, arrest records are public records. If they are in your state, all you have to do is trot on down to the county court and request a redacted copy of the arrest record. If they give you static about it, remind them it is your right under the Freedom of Information Act (Title 5, United States Code, section 522a) to request and obtain copies of public records with all privacy information like social security numbers obliterated so you can't read them. You'll probably have to pay a copying fee, but hey, it'll be worth it.

The DHS will do background checks on everyone involved the court will appoint a guardian ad litem to represent his daughter, They usually talk to the parents and the child to give to the Court for consideration.The Child's wishes and the States opinion of what the conditions are of each home When they talk to you tell them your concerns with the mothers questionable choice of live in. They will get the reports.

Do an online search, or call the county, city, state police department. Dispatch records are public records. Some police departments make dispatch logs public by online access, if not you will have to request a copy.
