I currently receive child support in the state of Illinois. I previously received help with my daughter's child care payment through Action for Children. Now my income is "too high" to get subsidy. However, my child care payments are too high to pay by myself. How can I receive help from my ex? Does my current child support order have to be changed? Do I go through child support and the state or is this a separate legal issue?

I do not believe you can get any more child support for child care unless the "circumstances have changed" dramatically. And since its not because you are making less that is effecting your ability to pay for child care but its because you are making more, I am pretty sure that you're out of luck...but consult a lawyer in any case (but keep in mind that you can't get more in child support than you are entitled to just because you can't afford something)...

Go to the attorney who handled your initial case or one that specializes in family law.

The attorney should be able to file a Motion to modify the original order if the father is receiving more pay than when the original order was signed.

If memory serves me correctly, each state has laws concerning a computed payment based upon the number of children and amount of income.

document. If he chooses now to not deliver it later, it would want to take months (if not years) to get it going then. you're literally not being vindictive. Frankly it protects him too. If he paid you money each month for the subsequent ten years, you may want to get mad and document for help, something he has given you right now is considered a "present" through the court and he might want to owe back for all those years.
