I was charged with domestic disturbance. Wife with domestic assault.

You are not required to do so, no.

Is it VERY SMART? Yes.

A person who represents themself in court has a fool for a client. Especially criminal court. Especially on domestic charges.

If you want to work things out with your domestic disturbing spouse you do; otherwise a restraining order may be issued by the Judge which will prohibit contact between the two of you for any reason.

Yes you do need a lawyer...because domestic dipsputes can lead up to divorces and negative things like that!!! Once you've been charged it's best that you have a lawyer on your side to keep up with everything that will happen after that. You'll never know what could happen or who could take who to court...or god forbid a divorce...you should be prepared!!! better safe than sorry

Not neccesarily...but the key is can you defend yourself adequately. Many times in these situations it is very uncomfortable for the judges and magistrates and they don't know what to do. It is best to have someone who won't soeak with emotion( the attorney is removed so will be open minded) and understands the court room procedure and can make a good impression.

In law school I pracitced in this area of law with Legai Aid for a year...it was a very uncomfortable situation and you could tell many of the judges I went before just didn't want to hear it at all....and I found in talking to my clients that judges responded better to me than they did when they were there alone.
