I live in NY State. My business wanted to expand to a facility next door also owned by my current business landlord. He verbally agreed twice and even once over email and gave me the keys. If he is trying to get out of it now is he already bound?

Needs to be in writing and signed by both parties.

If you have the email that should be binding, and why would he give you key's if he was not inclined to rent it to you? I think you have ample evidence of the agreement that you two made was accepted by each of You.
