Can an employer withdraw a position after you start working it?

I work in a union setting. I applied for, interviewed and was awarded another position. This position is not mentioned in the contract. After being promoted, someone in the bargaining unit filed a grievance and won a month later. I have already started this position and was informed today by administration that they are taking my promotion away and giving it to the less qualified person. Can they do this?

sounds like you were cheated..the union must be very weak if they let this slide..i could see if they eliminated the job..but why did they replace you with a less qualified person? sounds like a grievance...state employment should advise you if the union does not help you. maybe a lawyer that get paid only if he wins the case..something smells fishy..???

Ah, the sticky problem of working with Unions.

Since the employee won his grievance he gets his old job back. Because of this you lose your position and are returned to your previous position or any position that they can find, provided it doesn't mean a reduction in pay from your first position.

Another words yes the employer can do that.

The only recourse you have is to... file a grievance with the Union. Because they set up the situation that reduced you they should be held accountable for that, although they probably won't want to admit that or to help you. You can demand that the next time a similar position comes up you should be the first person considered.

Basically you are out of luck and as bad as it seems to you, you demotion is the fairest option.
