No they are not. Employers aren't supposed to ask any employee or applicant that. These are typically optional questions and you as an employee have the right to choose if you want to answer or not.

This data is to be provided on a voluntary basis. However, most employers present this information as part of the employment process. Most people who are out to get jobs are not likely to not fill out the forms as they may be concerned that it could jeopardize their chances to get a job. As for employees, they do not need to fill out this information.

However, organization strongly encourage employees to in order to prove their EEO compliance

No--employers are not permitted to ask, whether the person is an applicant or an employee. You'll notice that if they hand you a form asking for this information, it will always state that the information is voluntary.
